These Terms of Sale govern the sale of the Saaras electric kick scooter through the official website www.saaras.global
By placing an order through the website, the buyer agrees to these Terms of Sale, the Delivery Terms, the Terms of Use, and the Warranty Policy.
These Terms apply primarily to business and professional purchases. Personal consumer purchases may be accepted by exception and remain subject to applicable law.

2. Product and Intended Positioning

Saaras is a battery-powered electric kick scooter designed for use in controlled, non-public environments.

Saaras is intended primarily for workplace, campus, industrial, institutional, and tourism or recreational use cases. It is not intended for use on public roads or in traffic. Intended-use rules and operating restrictions are governed by the Terms of Use, the User Manual, product warnings, and the applicable Safe First Use Declaration.

3. Buyer Classification

At checkout, the buyer must select whether the purchase is being made for:

● business or professional use, or
● personal or consumer use.

For business or professional purchases, the buyer confirms that the purchase is made in the course of business or professional activity.
For personal or consumer purchases, the buyer confirms that the purchase is for personal, non-commercial use only.
Buyer classification may be assessed using the buyer’s declaration, business details, GST details if provided, billing details, delivery details, order profile, and the overall nature of the transaction.

4. Order Placement and Acceptance

Submitting an order on the website constitutes an offer to purchase.

A binding sale contract is formed only when:
● the order is accepted by Isolators & Isolators, and
● payment for the order is successfully received, subject to these Terms and the Delivery Terms.

Isolators & Isolators may decline or cancel an order before contract formation where necessary, including in cases of pricing error, stock or batch unavailability, suspected fraud, inconsistent buyer classification, or inability to fulfill the order.

5. Pricing, Taxes, and Discounts

The product price displayed on the website applies to the Saaras product only, unless expressly stated otherwise.
GST is charged additionally at the applicable rate, unless the website expressly states otherwise.
Discount codes, launch offers, or early-bird codes, where accepted, apply only to the product price unless expressly stated otherwise. Discounts do not automatically apply to GST, delivery-related charges, or any other amounts unless specifically stated.

6. Production Batch Allocation

Saaras is hand-fabricated and rider-fit-configured. Orders are subject to batch availability and production capacity.
Website references to open batch, available units, or allocation status are indicative of current production planning and may change based on order flow, manufacturing conditions, and confirmation steps under these Terms and the Delivery Terms.
An order is not deemed allocated to production merely because payment has been made, if further confirmation steps under the Delivery Terms remain pending.

7. Rider Height and Multi-Unit Orders

The website may collect rider height and related order inputs for configuration and fit purposes.
For multi-unit or institutional orders, final rider-specific sizing, unit allocation, and batch planning may be confirmed after order placement.
The buyer is responsible for providing accurate order information. Incorrect or incomplete information may delay fulfillment or require later clarification.

8. Delivery Charges and Delivery Process

Delivery is governed separately under the Delivery Terms, which form part of the sale contract.

The buyer acknowledges that:
● delivery charges are confirmed after order placement,
● final destination delivery charges are not automatically included in the product price unless expressly stated,
● delivery progression and production commencement are subject to the Delivery Terms.

9. Cancellation, Refunds, and Non-Completion

Cancellation and refund outcomes are governed by these Terms read together with the
Delivery Terms and Warranty Policy.

The buyer acknowledges and agrees that:
● after order placement, final delivery charges will be shared separately in accordance with the Delivery Terms;
● if the buyer chooses not to proceed after delivery charges are shared and before delivery charges are accepted and paid, the order amount paid will be refunded in full.
● production will begin only after delivery charges are confirmed and paid;
● if the buyer cancels the order after production has begun but before dispatch, 50% of the order amount will be refunded;
● no refund will be available after delivery of the product, except to the extent expressly required under applicable law.

This clause should be read together with the Delivery Terms, which govern delivery-stage mechanics and related process steps.

10. Business Purchases

For business or professional purchases, the buyer is responsible for ensuring that the product is acquired, managed, and used in accordance with the Terms of Use, the User Manual, applicable warnings, and the applicable Safe First Use Declaration.
Use by the buyer’s employees, contractors, or agents shall be treated as use by the buyer for purposes of the contractual allocation of responsibility under the sale and use documents.

11. Consumer Purchases by Exception

The buyer acknowledges that the applicable Safe First Use Declaration is not completed at checkout.

The applicable Safe First Use Declaration must be completed after delivery and before first use:
● SFUD-B2B for business or professional purchases
● SFUD-B2C for personal consumer purchases.

Failure to complete first-use requirements may affect warranty handling, misuse analysis, and support outcomes to the extent permitted by the governing documents and applicable law.

13. Limitation of Liability

For business and professional purchases, and to the maximum extent permitted by law:
● Isolators & Isolators shall not be liable for indirect, consequential, incidental, special, or business-interruption losses;
● Isolators & Isolators shall not be liable for loss of profit, loss of revenue, loss of business opportunity, or loss arising from misuse, unauthorized modification, unauthorized repair, or operation outside intended use;
● total aggregate contractual liability arising from the sale of the product shall not exceed the product purchase price actually paid for the relevant unit, except where a
higher liability cannot lawfully be excluded.

For personal consumer purchases, liability exclusions and limitations apply only to the extent permitted by applicable law. Nothing in these Terms excludes liability to the extent such exclusion is not permitted under applicable law.

14. Product Presentation, Site Responsibility, and Non-Reliance on Unapproved Statements

Because Saaras is hand-fabricated and rider-fit-configured, website images, videos, renders, finish presentation, and similar product materials are intended for general illustration only. Reasonable variation in finish, fabrication detail, non-material appearance, or rider-specific configuration shall not by itself constitute a defect, provided the product delivered substantially matches the agreed order specifications and core functionality.

The buyer is responsible for ensuring that the place where Saaras is intended to be used is suitable for such use and that any required internal permissions, access permissions, or local site approvals are obtained. Nothing in the website sale flow constitutes a representation by Isolators & Isolators that any specific premises, pathway, campus, estate, site, or area is legally or operationally suitable for Saaras use.

The buyer agrees that the governing product, sale, delivery, use, warranty, and approved website materials constitute the primary basis of the transaction. No statement by any third party, informal communication, or unapproved representation shall modify these Terms unless expressly confirmed in writing by Isolators & Isolators.

15. Governing Documents

The sale of Saaras through the website is governed by the following documents together:
● these Terms of Sale,
● the Delivery Terms,
● the Terms of Use,
● the Warranty Policy.

The applicable Safe First Use Declaration is a mandatory post-delivery first-use document and does not replace the sale contract.

If there is a conflict:
● Delivery Terms govern delivery-specific matters,
● Terms of Use govern operation and intended-use matters,
● Warranty Policy governs warranty coverage and exclusions,
● these Terms of Sale govern contract formation, pricing, classification, and general sale terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India.
Subject to applicable law, disputes arising from these Terms shall be subject to the courts having jurisdiction in Bhopal, Madhya Pradesh, India.

17. Changes to Terms

The version of these Terms accepted at checkout will govern that order.
Updated versions may apply to future orders only.
