1. About these Terms

These Terms of Use govern the operation and use of the Saaras electric kick scooter.

These Terms of Use apply to all buyers and users of Saaras and must be read together with:
● the Terms of Sale,
● the Delivery Terms,
● the Warranty Policy,
● the User Manual,
● product warnings and labels, and
● the applicable Safe First Use Declaration.

2. Product and Intended Use

Saaras is a battery-powered electric kick scooter designed for use in controlled, non-public environments.

Saaras is intended primarily for:
● workplace and campus mobility,
● industrial or institutional premises, and
● tourism, resort, or recreational environments.

Saaras is not intended for use on public roads, streets, highways, or in traffic / mixed traffic environments.
The product is not positioned or sold as a public-road commuting vehicle.

3. Mandatory First-Use Requirements

Before first operation, the buyer or user must:
● inspect the product for visible damage, missing parts, or abnormalities,
● review the User Manual and first-use safety instructions,
● complete the applicable Safe First Use Declaration, and
● avoid operation if any visible damage, malfunction, or abnormality is observed.

The applicable Safe First Use Declaration must be completed:
● by an authorized representative of the purchasing organization for business / professional purchases, or
● by the buyer for personal / consumer purchases.

4. Compliance with Instructions

The product must be used only in accordance with:
● these Terms of Use,
● the User Manual,
● first-use instructions,
● labels affixed to the product and other applicable warnings, and
● the applicable Safe First Use Declaration.

Failure to follow these materials may result in unsafe operation, damage, or injury.

5. Business / Professional Use Responsibilities

For business or professional purchases, the purchasing organization is responsible for  ensuring that:
● Saaras is used only in intended environments,
● only authorized personnel who have reviewed the applicable User Manual, first-use instructions, and warnings operate the product,
● safety instructions and operating limits are communicated internally, and
● the product is not operated contrary to these Terms or the User Manual.

Any use by employees, contractors, agents, or other personnel acting for or through the purchasing organization shall be treated as use by the purchasing organization.

6. Consumer Use by Exception

Where personal or consumer use is accepted by exception, the buyer remains responsible for operating Saaras only in intended environments and in accordance with these Terms, the User Manual, product warnings, and the applicable Safe First Use Declaration.
Nothing in these Terms is intended to exclude rights that cannot lawfully be excluded under applicable law.

7. Prohibited Uses

The following uses are prohibited:
● use on public roads or in traffic / mixed traffic environments,
● operation contrary to the User Manual or safety instructions,
● use in unsuitable, unsafe, or uncontrolled environments,
● use by unauthorized riders or riders operating contrary to the applicable instructions and warnings,
● operation after visible damage, malfunction, warning signs, or after a collision,impact, tip-over, or  similar incident without appropriate review,
● carrying passengers unless expressly approved in writing,
● unauthorized modification, disassembly, repair, or tampering,
● operation beyond specified load, environmental, or handling limits,
● any use inconsistent with the intended purpose of Saaras.

8. Warnings, Damage, and Abnormal Operation

If the buyer or user observes:
● visible damage,
● missing parts,
● unusual sounds,
● malfunction,
● abnormal response, or
● any other safety-related concern.

the product must not be used until the issue has been appropriately reviewed and addressed.
Continued use after visible damage, warning signs, or abnormal operation is outside intended use.
The product must also not be used after any collision, impact, tip-over, or similar incident until it has been appropriately reviewed.

9. No Unauthorized Modification or Repair

Saaras must not be modified, altered, disassembled, repaired, or tampered with except as expressly authorized by Isolators & Isolators.
Unauthorized modification or repair may:
● create safety risks,
● place use outside intended conditions,
● affect warranty handling, and
● affect support outcomes to the extent permitted by the governing documents and applicable law.

10. Public-Road and Traffic Use

Saaras is not intended for use on public roads or in traffic.
While public-road use cannot be physically prevented in all circumstances, such use is outside intended use and contrary to these Terms.

The buyer and user are responsible for ensuring that Saaras is used only in suitable, controlled, non-public environments.

11. Responsibility for Use

The buyer and user are responsible for:
● selecting an appropriate environment for operation,
● following all instructions and warnings,
● using the product responsibly,
● stopping use if any safety concern arises, and
● ensuring that first-use requirements are completed before operation.

For business purchases, these responsibilities apply both to the purchasing organization and to persons operating on its behalf.

12. Support and Interpretation

If any operational, safety, or usage-related question arises, the buyer or user should contact Isolators & Isolators before proceeding with uncertain or potentially unsafe use.
No informal statement by any third party shall vary these Terms unless expressly confirmed in writing by Isolators & Isolators.

13. Misuse and Consequences

Use outside these Terms, the User Manual, product warnings, or the applicable Safe First Use Declaration may constitute misuse.
Misuse may affect warranty handling, support outcomes, responsibility analysis, and any claim assessment, subject always to applicable law and the governing contract documents.

14. Relationship with Other Documents

If there is any conflict:
● these Terms of Use govern operation, intended-use rules, and prohibited-use rules,
● the Terms of Sale govern contract formation, pricing, and general sale terms,
● the Delivery Terms govern delivery-stage process and delivery-related consequences,
● the Warranty Policy governs warranty coverage and exclusions.

The applicable Safe First Use Declaration is a mandatory first-use document and must be read consistently with these Terms.

15. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of India.
Subject to applicable law, disputes arising from these Terms of Use shall be subject to the courts having jurisdiction in Bhopal, Madhya Pradesh, India.
